$770.00 - $990.00This course provides learners with the opportunity to test and apply their knowledge by examining current case law.
The learner-guided course consists of up to 10 real case studies, covering complex and significant issues across all sectors. Learners will workshop and discuss each example to extract sound, evidence-based principles, language, and criteria to guide and inform workplace decision making.
The course also reviews recent changes in legislation and is regularly updated to reflect the most current decisions and advice.
Target Audience
This course is suitable for HR professionals, managers, and employees with a good understanding of employment law and principles, including those who have completed AHRI’s Introduction to HR Law program.
Key Learning Outcomes
Following the training, depending on their chosen cases, participants will be able to:
- Explain and apply the test for a valid reason for dismissal.
- Explain and apply the test for constructive dismissal.
- Examine and determine the nexus.
- Assess evidence and draw appropriate conclusions.
- Evaluate conduct which may or may not justify termination.
- Identify, assess, and correct defects to ensure procedural fairness.
- Make decisions based on evidence and reasonableness.
- Identify and manage potential sources of bias and conflict.
- Consider and justify inherent requirements, accommodations, and flexible work decisions.
- Determine whether there are reasonable grounds for a belief.
- Interpret contract and Award terms and classifications.
- Apply the process for calculating compensation of adverse action claims.
- Support claims and procedures involving employees with complex physical and psychological health needs.
- Manage and respond to perceptions of employees.
