"AHRI"

Australian Human Resources Institute Ltd (ABN 44 120 687 149)

"Advertisers"

any person or organisation placing an advertisement on any of AHRI's e-Services

"Users"

all users of AHRI e-Services sites, including AHRI: ASSIST, HR:CAREERS, HR:BIZLIST, advertisers and unregistered visitors to any of the AHRI e-services sites.

"AHRI e-Services"

any AHRI-owned or operated or maintained web service, including ahri.com.au

Your access to and use of the AHRI e-Services is conditional on your acceptance and compliance with the terms, conditions, notices and disclaimers contained on this page and elsewhere on AHRI e-Services sites. Your access to the AHRI e-Services constitutes your agreement to be bound by these terms and conditions.

  1. COPYRIGHT AND TRADEMARKS
    1. All intellectual property rights (including future copyright) in the information and other  material appearing on AHRI e-services vests in and is the exclusive property of AHRI and its authorised suppliers. If AHRI permits you to advertise or post on its e-services you grant AHRI an irrevocable, permanent and royalty-free licence to use any advertisement that has been submitted by you for placement on AHRI e-Services or any other medium owned by AHRI. You may not and must not allow or permit other parties on your behalf to copy advertisements, or to undertake site scraping or other similar activities unless you have obtained prior permission from AHRI.
    2. If you would like to complain to AHRI about potential infringements of copyright on AHRI's website you can contact Laura Kroll via Laura.Kroll@ahri.com.au. You can also contact Laura if you would like permission to use materials from the AHRI website. AHRI retains the right to remove material that we consider may infringe copyright.

  2. LEGAL JURISDICTION
    1. AHRI e-Services are controlled by AHRI and by accessing them you accept that any disputes arising out of your use of AHRI e-Services or its contents, as well as terms governing your use and membership shall be governed by the courts having jurisdiction in the State of Victoria in Australia in accordance with the laws in force in the State of Victoria in Australia. AHRI e-Services may be accessed throughout Australia and overseas. AHRI makes no representation that the material available these services complies with the laws of any country outside Australia. If you access these services from outside Australia you are responsible for ensuring compliance with all applicable laws in the place where you are located.
  3. PRIVACY POLICY
    1. Personal data will be handled in accordance with AHRI's privacy policy.
  4. ACCEPTABLE USE
    1. ahri.com.au
      Certain sections of ahri.com.au are restricted to AHRI members and students of AHRI courses, or to subscribers to the particular section of ahri.com.au. AHRI reserves the right to designate pages as member-only.
    2. AHRI: ASSIST
      1. AHRI: ASSIST provides AHRI members with access to human resources management information and resources.
      2. By using the AHRI: ASSIST service, you agree to comply with both these Terms of Use, and with the terms of use applicable to the AHRI: ASSIST service, which may be found at www.ahri.com.au/assist.
    3. HR:BIZLIST
      1. HR:BIZLIST is provided for the purpose of introducing companies and organisations to individuals and organisations that may require their services. All Users agree to refrain from using information posted on the site to send unsolicited communications other than for those purposes.
      2. Advertisers agree that any information posted on HR:BIZLIST will be true and correct at the time of posting and accept responsibility for any incorrect information.
      3. Advertisers agree that any information posted will not be in breach of copyright, obscenity, anti-discrimination and other legislation, and agree not to post potentially or actually defamatory or libellous material, or publish information that may be misleading.
    4. HR:CAREERS
      1. HR:CAREERS exists to allow organisations, or their authorised representatives, to advertise job opportunities and for job seekers to apply for those jobs. In addition, HR:CAREERS allows job seekers to post their CV and allow it to appear in search results for organisations searching for a candidate with appropriate skills. Users may choose to allow organisations to contact them as a result of these searches. All Users agree not to use the site for other purposes and agree not to send unsolicited information other than for the purposes outlined in these Terms of Use.
      2. Advertisers agree that any information posted on HR:CAREERS will be true and correct at the time of posting and accept responsibility for any incorrect information.
      3. Advertisers agree that any information posted will not be in breach of copyright, obscenity, anti-discrimination and other legislation, and agree not to post potentially or actually defamatory or libellous material, or publish information that may be misleading.
      4. Advertisers agree that only one position may be advertised per advertisement, except where multiple appointments will be made with the same job title, job description and responsibilities and salary, less any regional adjustments
      5. Advertisers agree they will not perform any refresh or reposting of advertisements purely for the purpose of restoring those advertisements to the top of any search listings.
    5. AHRI Bookshop
      1. AHRI Bookshop exists to allow organisations and individuals to purchase HR related texts and& resources as sought by the Australian Human Resources Institute Ltd. All purchases will be made in accordance with the Shipping / Pricing policy andn all Prices are in Australian Dollars and are inclusive of Australian GST (Goods and Services Tax).
      2. The information contained in the AHRI Bookshop may contain technical inaccuracies or typographical errors. All liability of AHRI howsoever arising for inaccuracies or errors is expressly excluded to the fullest extent permitted by law.
      3. Australian Human Resources Institute Ltd is the copyright owner of the content of AHRI Bookshop or is permitted by the copyright owner to use the content on the website. Brand names, cover images, characters, book titles and other product information used in this site may be the trademark or intellectual property of a registered holder. No permission is given in respect of use of any of the above, and such use may constitute an infringement of the holders' rights.
  5. LIABILITY
    1. Accuracy of information
      1. All information on AHRI e-Services is provided 'as seen' and AHRI accepts no liability for loss or damage caused as a result of reliance on information posted on any AHRI e-Service, whether that information has been posted by AHRI or by an advertiser or user of AHRI e-Services.
      2. AHRI accepts no liability for damages incurred as the result of inadequate, late or missing service from any advertiser on any AHRI online service.
    2. Indemnity
      1. Users will at all times indemnify and will continue to indemnify, hold harmless and defend AHRI, its related bodies corporate and their respective personnel from and against all liabilities, costs, damages, expenses, claims, suits, allegations and demands, including, without limitation, all legal fees (incurred on a solicitor and own client basis), arising out of or in relation to:
      2. (a) any infringement, or claim or allegation of infringement, of the intellectual property rights or any other proprietary rights of a third party; and
      3. (b) any fraud, deliberate or wilful misconduct or negligence or breach of these terms and conditions committed by users.
    3. Availability of service
      1. AHRI provides its e-Services on an 'as and when available' basis and makes no guarantee as to the availability or performance of the sites. Where a link appears to an external website maintained by a third party, AHRI gives no endorsement as to the services operated by those websites.
    4. Security
      1. AHRI will take all reasonable steps to maintain the security of information provided by advertisers and Users of the site but will not accept responsibility for breaches of security or unauthorized access that arise as a result of disclosure by Users of their login details. Users remain responsible at all times for maintaining the confidentiality of their login details, username and password and AHRI accepts no liability for the misuse of these details.
      2. While AHRI also takes reasonable steps to ensure AHRI e-Services are virus free, Users acknowledge that they access AHRI e-Services at their own risk and that AHRI is not responsible for any damages caused as a result of accessing AHRI e-Services. This includes, but is not limited to, any monetary or other loss that may result from loss or corruption of data, system downtime or hardware damage.
    5. Links to other websites
      1. AHRI e-Services may contain links or other references to other parties or websites. AHRI cannot control the contents of those other sites, and makes no warranty about the accuracy, timeliness or subject matter of the material located on those sites. AHRI does not necessarily approve of, endorse or sponsor any content or material on those sites.
      2. AHRI makes no warranties or representations that material on other websites to which AHRI e-Services are linked does not infringe the intellectual property rights of any person anywhere in the world.
      3. AHRI is not, and must not be taken to be, authorising infringement of any intellectual property rights contained in material on other sites by linking to them from AHRI e-Services.
  6. RIGHT OF REFUSAL
    1. In the event that you breach any of these conditions AHRI reserves the right to refuse publication or to remove from the public domain any posting, advertisement or comment on any AHRI e-Services at any time without prior notice, and where payment has already been made to withhold from any refund an amount equivalent to any costs incurred and/or service already supplied.
  7. PAYMENT
    1. Payment for services supplied by AHRI must be made in accordance with the terms stated on the payment page, or in accordance with any separate agreement entered into.
  8. SUSPENSION
    1. AHRI reserves the right to remove service, cancel user accounts and remove from AHRI e-Services any posts in the event of any breach of these Terms of Use, non-payment for services, breach of the talk policy or conduct which is likely to be detrimental to the good name or reputation of AHRI and its members.
  9. GENERAL RULES
    1. When usin g AHRI e-Services, Users must:
      1. Ensure that the content they post on AHRI e-Services is not obscene (including but not limited to any pornography), defamatory, threatening, harassing, discriminatory or hateful to any person or entity.
      2. Ensure that the content they post on AHRI e-Services is not confidential or commercially sensitive unless they own all rights to the content.
      3. Ensure that the content they post on AHRI e-Services does not include another person's personal information without that person's express written consent.
      4. Ensure that the content they post on AHRI e-Services does not breach applicable legislation including laws relating to copyright, privacy, financial disclosure, discrimination/equal opportunity and defamation.
      5. Be respectful of all individuals and communities with whom/which they interact on AHRI e-Services.
      6. Be polite and respectful of others' opinions on AHRI e-Services.

Terms of Use – AHRI: ASSIST

Use of the services (Member Services) provided by Australian Human Resources Institute Ltd (ABN 44 120 687 149) (AHRI) at www.ahri.com.au/assist (Site) is conditional upon you being an AHRI member and agreeing to these terms of use.

  1. Acceptance of terms
    1. By continuing to use this Site, you acknowledge that you have read and agree to be bound by these terms of use as amended from time to time (Terms of Use).
    2. AHRI may, in its absolute discretion, modify or amend these Terms of Use from time to time and those modifications or amendments will be binding on you once displayed on this Site. You agree to be bound by these Terms of Use as amended and agree to review the Terms of Use before using this Site.
  2. Becoming a Member
    1. To use the Member Services you must be registered as an AHRI member and comply with these Terms of Use at all times.
    2. If you are an AHRI member, you may continue using the Member Services until the earlier of:
      1. the expiration or termination of your membership; and
      2. the termination of your access to the Member Services, in accordance with these Terms of Use.
  3. Termination of membership
    1. AHRI may, in its absolute discretion, and without notice or liability to you, terminate your access to the Member Services if:
      1. you breach these Terms of Use; or
      2. you act in a way that, in the opinion of AHRI, is likely to be detrimental to the interests of AHRI.
    2. These Terms of Use will survive any termination of access under clause 3a
  4. Warranties provided by you
    1. You warrant and acknowledge that:
      1. you will not use this Site for any illegal or fraudulent purpose;
      2. you will not impede the use of this Site by any person;
      3. you will not impersonate any other person or allow any other person to impersonate you or make use of your username or password.
  5. COPYRIGHT AND TRADEMARKS
    1. All intellectual property (including future copyright) in the information and other material appearing on the Site vests in and is the exclusive property of AHRI and its authorised suppliers, or is licensed to AHRI. Other than as permitted by the Copyright Act 1968 (Cth) or as expressly allowed by these Terms of Use, no part of the Site may be modified or reproduced by any process without the specific written permission of AHRI.
    2. You may view this Site using your web browser and save electronic copies or print out copies of parts of the Site, for the sole purpose of personal use or use internal to your business. You may also modify the content of such copies, solely so that the content relates to your business, but you must otherwise maintain the integrity of the content. AHRI will not be liable for any changes to the content. AHRI does not licence you to use content from the Site for commercial purposes, other than commercial purposes internal to your business (for example, managing your business' human resources).
  6. ACCESS TO THE SITE
    1. You must not access or use the Site, or the content provided on it, in any manner or for any purpose which:
      1. is illegal or prohibited by any laws that apply to you;
      2. violates AHRI's rights in any way; or
      3. is prohibited by these Terms of Use.
    2. You must take your own precautions to ensure that the process which you employ for accessing the Site does not expose you to the risk of viruses, malicious computer code or other forms of interference which may damage your own computer system.
  7. DISCLAIMER AND LIMITATION OF LIABILITY
    1. The content on this Site provides general information only.     1. AHRI will take all reasonable steps to maintain the security of information provided by you but will not accept responsibility for breaches of security or unauthorized access that arise as a result of any disclosure by you of your login details.
    2. You agree and acknowledge that:
      1. you remain responsible at all times for maintaining the confidentiality of your login details, username and password;
      2. you will immediately notify AHRI if any of this information has been lost, stolen or compromised in any way; and
      3. AHRI accepts no liability for the misuse of this information.

    1. This Site may contain links or other references to other parties or websites. AHRI cannot control the contents of those other sites, and makes no warranty about the accuracy, timeliness or subject matter of the material located on those sites.     1. If we waive any rights available to us under these General Conditions on one occasion, this does not mean that those rights will automatically be waived on any other occasion.
  13. ENTIRE AGREEMENT
    1. Together with the terms of use applicable to the AHRI website, which may be accessed at www.ahri.com.au, these Terms of Use set out the entire agreement and understanding between you and AHRI and supersede all prior agreements, understandings, representations and warranties, whether express or implied.
  14. PROVISIONS SEVERABLE
    1. If any provision of these Terms of Use is invalid, illegal or unenforceable in any respect, the validity, legality and enforceability of the remaining provisions will not be affected, and such invalid, illegal or unenforceable provision is to be severed from these Terms of Use.
